Terms & Condition

General

Your entry into Pro Fit Badminton (PFB) center (including car park) located on Lot 1/86-102 Whiteside Rd,
Clayton South VIC 3169 (Venue) is subject to these terms and conditions of entry, as amended from time to time (Conditions). It is your responsibility to inform yourself of these Conditions. By entering the Venue, you are deemed to have accepted and understood as binding on you these Conditions and any accompanying risks, obligations and responsibilities.

Conditions of Entry

  • PFB reserves the right to refuse entry to or remove any person from the Venue.

  • PFB prohibits certain behaviour, conduct and activities at the Venue. A current list of the prohibited behaviour, conduct and activities is listed in the attachment headed "Prohibited Behaviour ". PFB reserves the right to add to or change this list at any time.

  • Non-marking shoes must be worn on court surfaces at all times. Patrons must be suitably and appropriately attired at all times while within the Venue.

  • You are responsible for your own property (including, without limitation, any motor vehicle) and PFB will not be liable for loss, damage to or theft of any property brought to the Venue.

  • Unaccompanied children under 10 years of age are not permitted entry to the Venue unless accompanied by a person at least 16 years of age, or where participating in a social event held at the Venue. If you bring children under 18 years of age to the Venue, you are responsible for the care, conduct and supervision of those children at all times and must keep those children within your sight at all times.

Food

Food is prohibited from any field of court surface area.

Security Cameras

Security cameras operate within the Venue (including car park). By entering the Venue, customers implicitly consent to be recorded. 

Cancellation and Refund Policy

Cancellation is accepted and payment will be refunded if booking is cancelled more than 24 hours from the commencement of the court booking. You will not be entitled to a refund if a booking is cancelled within 24 hours from the start time of the booking. For online bookings, refund will be provided as a store credit by default, which can be used in future court bookings. You will need to contact PFB or visit court reception in person should you require a cash refund or refund to card.

Privacy Policy

We are committed to protecting your personal information and agree to handle your personal information in accordance with our Privacy Policy, which is available online at . By way of general comments, in providing personal information to us, you agree that our Privacy Policy will apply to how we handle your personal information and you consent to us collecting, using and disclosing your personal information as detailed in our Privacy Policy.

PFB may share your personal information with third parties such as Google Analytics, and other organisations engaged to carry out functions and activities on PFB behalf, including direct marketing, or otherwise in accordance with PFB’s Privacy Policy.

Limitation of Liability

  • Your participation in any physical activity at the Venue, including but not limited to the use or enjoyment of any facilities or equipment at or within the Venue (Physical Activities) is dangerous. You acknowledge that you are exposed to certain risks during any participation in Physical Activities at the Venue, including but not limited to physical or mental injury, other participants acting dangerously or with lack of skill, and that accidents can and often do happen.

  • You indemnify and agree to keep indemnified PFB and its employees, contractors and agents against any liability for any claim, loss (including pure economic loss), damage, costs and expenses arising from your acts or omissions at the Venue.

  • Under no circumstances whatsoever will PFB accept liability for any loss suffered by you as a result of the cancellation or postponement of any Event held at the Venue or for any expectation damages associated with your attendance at the Venue, including without limitation, damages on the basis of loss of chance or opportunity.

 

Appendix: Prohibited Behaviour

  • Smoking, vaping, or alcohol consumption

  • Litter

  • Abusive behaviour towards court staff or other customers

  • Abuse online booking system

  • Misuse, deface, damage, remove from the Venue or tamper with or attempt to misuse, deface, damage, remove from the Venue or tamper with any building, plant, structure, signage, equipment or thing


Privacy Policy

 

Pro Fit Badminton (PFB) collect, use, disclose and manage personal information (which includes sensitive information and health information) about people using its facilities and services and its staff. PFB is committed to protecting personal information in accordance with legislation, such as the Privacy and Data Protection Act 2014 and Freedom of Information Act 1982.

When does PFB collect personal information

Personal information may be collected when you:

  • book court via phone;

  • book court via online booking system;

  • participate in any social events held at PFB;

  • participate in any competitions held at PFB;

  • access the PFB website;

  • contact PFB via email, telephone or mail or engage with PFB via social media;

  • attend PFB premises subject to surveillance.

Personal information may also be collected where PFB is required to do so by law (for education, child protection, work health and safety laws, charitable collections, medical treatment, or other legislation in Australia).

How does PFB collect personal information

PFB, and third parties to whom we may disclose personal information, may collect, hold and use your personal information to:

  • verify your identity;

  • complete background and security checks;

  • respond to safety and emergency situations;

  • address security and crime-prevention and detection purposes;

  • conduct research, develop, run, administer and market competitions, programs, activities and other events relating to PFB and its services;

  • conduct research, develop and market products, services, merchandise and special offers made available by us and third parties;

  • keep you informed of news and information relating to various PFB events, activities and opportunities via various mediums;

  • administer, manage and provide you with access to PFB website;

  • comply with legislative requirements, such as the Child Safety Standards.

The PFB may disclose personal information to a range of organisations which include, but are not limited to:

  1. entities engaged by the PFB to carry out functions and activities on the PFB’s behalf, including direct marketing;

  2. our professional advisers, including accountants, auditors and lawyers;

  3. insurers;

  4. relevant bodies such various national and state sporting bodies, federal and state departments relating to health and sports;

  5. law enforcement agencies; and

  6. in other circumstances permitted by law.

  • to seek further information about the PFB’s collection, use, disclosure and management of personal information; or

  • to raise any issues or complaints in relation to the collection, use, disclosure, quality, security of and access to your personal information. We will respond to your complaint within a reasonable period and try to resolve your complaint for you.

PFB may amend this Privacy Policy from time to time.
